Displaced Worker Legislation These Local ordinances and state laws require private landlords to let janitors and security guards keep their jobs when they change building services contractors. These laws, which are currently on the books in N.Y.C., Washington, Philadelphia and California, ensure continuity in employment and prevent landlords from union-busting by shifting to a low-road, non-union firm when their contractor is organized. Under federal labor law, if the workers retained by a successor contractor were previously unionized, the successor must recognize the union without need for a new election. Displaced worker laws have also been extended to parking lot and rental car workers in San Francisco, and hotel workers in Santa Monica. Model language coming soon. |
