     In an unusual move, the Treasury Department has reopened comment period on a proposal to continue to allow banks to accept foreign id, such as the matricula consular, to open bank accounts. This provision saves money for immigrant workers who would otherwise not have access to banking. It saves lives of immigrants subject to robberies.      NELP, along with other advocates, has submitted a brief to the Interamerican Court outlining the devastating impacts on immigrant workers resulting from the U.S. Supreme Court's decision in Hoffman Plastic Compounds v. NLRB. The brief shows that the decision violates fundamental principles of international law that bind the U.S. The Court will hear oral argument on February 24, 2003. (February 2003)          

Used and Abused: The Treatment of Undocumented Victims of Labor Law Violations Since Hoffman Plastic Compounds v NLRB    03/27/2003

     Since the U.S. Supreme Court's decision in the Hoffman case, denying back pay to undocumented workers illegally discharged for engaging in union organizing, employer retaliation against undocumented workers is on the rise. This report documents nationwide efforts by employers to convince courts that undocumented workers have no labor rights at all and their extrajudicial threats to report workers to INS. Background on Complaint under North American Agreement on Labor Cooperation    02/04/2003

     The North American Agreement on Labor Cooperation (NAALC) is the side agreement to NAFTA under which each of the three countries that are parties to NAFTA agree to enforce their own labor standards, and to strive to improve labor standards in their country. It is often also called the labor side agreement to NAFTA.
